1. Acceptance of Terms

By accessing or using Kabadigo.in (the "Platform") to sell scrap materials including but not limited to metals, plastics, paper, e-waste, glass, rubber, and other recyclable items, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our scrap selling services. These Terms apply to all sellers: individuals, households, businesses, bulk suppliers, and scrap aggregators.

2. Eligibility & Account Responsibility

You must be at least 18 years old and legally competent. Business entities must have valid GST (if applicable). You agree to provide truthful, accurate, and complete information during registration, scrap listing, or pickup scheduling.

• ✅ You confirm lawful ownership of scrap or explicit authorization from owner.
• ❌ Any fraudulent, stolen, or illegally obtained scrap is strictly prohibited.
• 🔄 Kabadigo reserves the right to suspend/terminate any seller account for misrepresentation or violation of laws.

3. Scrap Categories & Pricing Model

Kabadigo provides estimated market rates based on quality, weight, and commodity trends. Final price is determined after physical inspection by our authorized collection agent. Major categories include:

Price revision right: If on-ground verification reveals contamination, moisture, or quality mismatch, the final offer may be revised. Seller can either accept revised price or cancel transaction without penalty (scrap returned).

4. Pickup Scheduling & Logistics

Once a scrap sell request is confirmed, Kabadigo assigns a pickup slot and a verified collection partner. Key conditions:

• 🚚 Minimum order value applies for free doorstep pickup (details visible at checkout). Low-value scrap may be consolidated.
• 📍 Accurate address & landmark required. If agent cannot access due to locked premises/wrong location, rescheduling fee may be charged.
• ⏰ Cancellation within 2 hours of scheduled pickup may result in temporary service restriction.
• 🌧️ Force majeure (heavy rain, strikes, lockdowns) may delay pickup; we will notify rescheduling.

5. Weighing & Verification Process

At collection, the agent weighs the scrap using certified digital scales. Sellers have the right to observe weighing. Once scrap is handed over and receipt generated, transaction is considered final. Any attempt to artificially increase weight (adding stones, water, foreign objects) results in immediate forfeiture of payment and permanent ban.

6. Payment Terms & Settlement Window

After weight confirmation, payment is processed via:

• 💸 UPI / Bank Transfer (within 24 hours of successful pickup).
• 💵 Cash on delivery (only for small-value pickups, based on agent availability).
• 📱 Kabadigo wallet credit (instant, can be withdrawn later).

Dispute window: 7 days from pickup date. We will review weighbridge slips, geo-tagged images, and agent logs. If error is proven, differential amount paid within 5 business days.

7. Prohibited Items & Seller Obligations

You shall not offer the following items for sale via Kabadigo:

• 🔴 Hazardous waste: chemical drums, oil filters, asbestos, paint residue.
• 🔴 Medical/biohazard: syringes, infectious waste, pathological waste.
• 🔴 Explosives, ammunition, fireworks, gas cylinders (with contents).
• 🔴 Stolen property, illegally sourced metals, or disputed materials.
• 🔴 Any item violating Indian laws (Environment Protection Act, Solid Waste Rules).

You indemnify Kabadigo against all claims, fines, damages arising from prohibited scrap. You agree to sort scrap into basic categories (metal, plastic, e-waste) for efficient processing.

8. Limitation of Liability

To the fullest extent permitted by law, Kabadigo (including affiliates, employees, agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from scrap transactions. Our total aggregate liability for any claim related to your scrap sale is limited to the exact transaction amount paid to you.

Kabadigo acts only as an intermediary platform connecting sellers and recyclers. We do not guarantee maximum market price at all times, and we are not liable for delays caused by third-party logistics, natural disasters, or governmental restrictions.

9. Indemnification

You agree to defend, indemnify, and hold harmless Kabadigo, its directors, employees, and partners from any claims, damages, losses, liabilities, costs, and legal fees arising from: (i) your breach of these Terms; (ii) your violation of applicable laws; (iii) any hazardous or illegal material included in your scrap; (iv) misrepresentation of ownership or fraud.

10. Termination & Suspension

Kabadigo may suspend or terminate your access to scrap selling services without prior notice if: (a) you provide false identity or scrap details; (b) repeated cancellations or abusive behavior; (c) involvement in illegal scrap trade; (d) non-payment of any applicable fees. Upon termination, pending payments may be withheld pending investigation.

11. Governing Law & Dispute Resolution

These Terms shall be governed by Indian laws. Any dispute arising from Kabadigo scrap services shall be subject to exclusive jurisdiction of courts in Mumbai, Maharashtra. Parties agree to attempt good-faith negotiation for 30 days before litigation. Grievance officer: legal@kabadigo.in (response within 10 business days).

12. Amendments to Terms

Kabadigo may revise these Terms at any time by updating this page. The "Last updated" date indicates changes. Continued use of services after modifications constitutes acceptance. It is your responsibility to review periodically.
